Higher Refusal Rates for R-1 and F-2 Visas at U.S. Consular Posts in India

In a recent trend, we have noticed an alarming number of refusals of R-1 (Religious Worker) and F-2 (dependent of F-1 student) visa applications at consular posts in India.

The following factors may influence the decision for F-2 applicants:

  • Evidencing relationship to the F-1 applicant;
  • Establishing independent nonimmigrant intent: Until about a year and half ago, the intent of the primary F-1 student was applicable for the dependent. However, the foreign affairs manual has been amended and now, dependents must individually provide evidence to overcome the presumption of immigrant intent. This has resulted in an increased rate of refusal of F-2 visa applications.

The following factors may influence the decision for R-1 applicants:

  • Prior travel history to the United States;
  • Proposed activities on the current trip; and
  • Establishing the fact that the R-1 beneficiary will depart the United States at the end of the validity period of the R-1 petition.

It is important to present all facts clearly and unambiguously to maximize possibility of a successful application.
